The terms governing your use of the OG01 platform, scoring services, reports, remediation services and licences.
These Terms of Service govern your access to and use of OG01™, including its website, platform, scoring services, Smart Cards, reports, remediation services, dashboards, rescoring services and licences. By using OG01 or purchasing a service from us, you agree to these Terms. If you do not agree to these Terms, you should not use the platform or purchase the service.
OG01™ is operated by OG One Pty Ltd, ABN 23 676 552 855, Director: Matthew Kane, Suite 3, 5 Easy Street, Byron Bay NSW 2481, Australia.
OG01 is a scoring, diagnostic and remediation platform designed to identify and improve factors affecting how organisations, brands, properties and websites are understood, retrieved and represented across modern search and AI-enabled discovery systems. OG01 may incorporate proprietary and licensed technologies, scoring methodologies, software, data sources and third-party services as part of delivering the service.
OG01 may analyse a submitted domain, property, organisation or brand and produce outputs including: an overall score; Smart Card readings; diagnostic findings; search and brand intelligence; technical and retrieval findings; AI-readiness and risk findings; reports; Priority Action Plans; remediation recommendations; remediation status; and rescoring and historical comparisons.
Depending on the product or service purchased, OG01 may also provide managed remediation designed to address findings identified during scoring. Free, paid, managed and enterprise services may be available. The specific features, deliverables, usage limits, property or domain limits and service inclusions applicable to your purchase will be described at the point of purchase, in an order form, proposal, statement of work or other agreement with us.
An OG01 score is a measurement or assessment made at a point in time using the information, signals, methodologies and data available when the analysis is performed. Scores may change when: a website changes; third-party information changes; search or AI systems change; technical conditions change; new information becomes available; remediation is completed; or OG01 methodologies and data sources are updated.
OG01 scores, findings and reports are decision-support tools. They are not guarantees of search ranking, AI inclusion, recommendation, traffic, bookings, revenue, commercial performance or any other particular result.
Where you purchase remediation services, OG01 will identify and prioritise work based on the findings generated through scoring and analysis. Remediation may include work relating to website structure, technical accessibility, retrieval, entity clarity, structured data, content, source evidence, location information, citations and other factors identified through the OG01 assessment. The precise remediation work included will depend on the service, proposal or scope you purchase.
Some remediation may be performed directly by OG One Pty Ltd or its contractors. Other remediation may require implementation by your internal team, website provider, agency, developer or another third party. Where implementation requires access to your website, systems or third-party services, you are responsible for providing the necessary access, permissions and approvals. We will not make material changes to systems or properties outside the agreed scope.
Where rescoring is included or purchased, OG01 may conduct a subsequent assessment after remediation or after an agreed period. A rescore is intended to identify changes in measured signals following the original assessment. A change in score does not guarantee a corresponding change in search rankings, AI recommendations, website traffic, bookings, revenue or other commercial outcomes.
Some OG01 features may require an account or licence. You are responsible for: maintaining the confidentiality of your account credentials; keeping licence credentials secure; ensuring account information is accurate; and activity performed through your account.
Licence rights, scan volumes, portfolio limits, user limits and other restrictions are determined by the product or agreement you purchase. You must not share, resell, sublicense or commercially redistribute an OG01 licence except where expressly permitted by your agreement with us.
You may use OG01 only for lawful purposes. You must not: violate applicable laws or regulations; attempt to reverse engineer, extract, copy or replicate OG01 software, scoring logic or protected methodologies; introduce malware, malicious code or other harmful material; attempt to interfere with or disrupt the platform or its infrastructure; bypass access, authentication, rate or usage controls; use automated access outside functionality or API access expressly authorised by us; exceed the limits applicable to your licence or service; use OG01 to harass, unlawfully monitor or harm another person or organisation; misrepresent your relationship with OG01; or use OG01 scores, reports or branding in a false, misleading or deceptive manner.
You may submit publicly accessible domains for legitimate analysis, including domains that you do not own, provided your use is lawful and does not breach these Terms.
Prices for OG01 services are displayed at the point of purchase or set out in a proposal, order form or agreement. Pricing may vary according to: product; number of properties or domains; scan or rescore volume; remediation scope; service level; licence type; and enterprise requirements. Prices may be displayed in Australian dollars, United States dollars or another stated currency.
Payments are processed securely through Stripe or another payment provider identified at the point of purchase. By making a purchase, you authorise the payment provider to charge the applicable amount to your selected payment method. We may change our prices from time to time. Changes will not retrospectively alter a completed purchase or an agreed fixed-price service unless otherwise provided in an applicable agreement.
Some OG01 products or licences may be offered on a recurring monthly or annual subscription. Where a subscription renews automatically, this will be disclosed at the point of purchase. Unless otherwise stated, recurring subscriptions continue until cancelled. You may cancel an eligible subscription before its next renewal date. Cancellation takes effect at the end of the current paid billing period unless another arrangement is stated in your agreement. We do not provide pro-rata refunds for unused portions of a billing period unless required by law or expressly agreed otherwise.
Scoring reports and other digital outputs may be generated specifically for the domain, property or organisation submitted. Because these outputs are generated and delivered on demand, change-of-mind refunds may not be available once a report or scoring service has been delivered. Where remediation or another service has not yet commenced, any refund entitlement will depend on the applicable purchase terms, scope of work and Australian law.
If: a service materially fails to be supplied as agreed; you were charged incorrectly; there is a genuine fault with the service; or Australian law provides you with a right to a remedy, please contact us at [email protected]. Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded.
Our services come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy provided under the Australian Consumer Law or another law where doing so would be unlawful. Where the law permits our liability for a failure to comply with a consumer guarantee to be limited, our liability may be limited to supplying the service again or paying the cost of having the service supplied again, as permitted by law.
You are responsible for information, instructions, access and materials you provide to OG01. Where remediation involves your website, platform or other digital systems, you are responsible for ensuring that: you have authority to provide the required access; appropriate backups are maintained; relevant internal approvals have been obtained; information supplied to us is accurate; and any third-party provider whose cooperation is required is appropriately authorised. We are not responsible for delays caused by failure to provide required access, information, approvals or third-party cooperation.
OG01 outputs may draw on publicly available information, information supplied by customers and data from third-party providers. We work to make OG01 scoring and recommendations useful and reliable, but internet, search, AI and third-party data environments change frequently. Scores and findings are therefore assessments and interpretations rather than guaranteed statements about future performance. You should apply appropriate business judgement when relying on an OG01 report, particularly where a decision may have significant commercial, technical, financial or legal consequences.
Unless otherwise stated, OG01 software, platform content, scoring systems, reports, designs, workflows, visual assets and other materials are owned by OG One Pty Ltd or used by OG One Pty Ltd under licence. This includes intellectual property incorporated into OG01 through third-party or licensed technology. Your purchase of an OG01 report or service does not transfer ownership of OG01 intellectual property to you.
Unless your agreement states otherwise, reports and deliverables provided to you may be used: within your own business; by your employees and internal teams; by advisers working for your business; and by agencies or service providers acting on your behalf. You must not resell, white-label, republish or incorporate OG01 scoring, reports, methodologies or protected materials into another commercial product or service without our written permission or an applicable licence. Nothing in these Terms grants you ownership of OG01 names, branding, software, methodologies or other intellectual property.
Where either party receives non-public business, technical, operational or commercial information from the other in connection with a paid remediation or enterprise engagement, that information must be handled confidentially and used only for the purpose for which it was supplied. This does not apply to information that is publicly available, independently developed, already lawfully known, or required to be disclosed by law. More detailed confidentiality requirements may be included in an enterprise agreement, proposal, NDA or statement of work.
OG01 relies on and may integrate with third-party infrastructure, payment providers, email providers, data services, search systems and other external services. We do not control those third-party services. Availability, data, interfaces and functionality provided by third parties may change without notice. Where a third-party change affects OG01, we may modify the service, methodology or output as reasonably necessary. Links to external websites or services do not necessarily constitute endorsement.
We aim to keep OG01 available and operating reliably. We do not guarantee that the platform will be uninterrupted or error-free at all times. The service may occasionally be unavailable because of: scheduled maintenance; updates; security work; third-party service interruption; infrastructure failure; or circumstances outside our reasonable control. We will take reasonable steps to restore affected services where practical.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited, including rights that may apply under the Australian Consumer Law. To the maximum extent permitted by law, OG One Pty Ltd is not liable for indirect, consequential or special loss arising from use of OG01, including loss of profit, revenue, business opportunity or anticipated savings, except where liability cannot lawfully be excluded. Where the law permits liability in relation to services to be limited, OG One Pty Ltd may limit its liability to re-supplying the relevant service or paying the reasonable cost of having that service re-supplied. Any additional or different liability arrangements agreed for an enterprise or managed service engagement may be set out in the applicable proposal, order form, statement of work or contract.
To the maximum extent permitted by law, you agree to indemnify OG One Pty Ltd against any loss, damage, cost, expense or liability (including reasonable legal costs) that OG One Pty Ltd reasonably incurs arising from: your unlawful use of OG01; your breach of these Terms; your submission of a domain, property or organisation in breach of these Terms or applicable law; your use of OG01 scores, reports or outputs in a false, misleading or deceptive manner; or a claim by a third party arising from your use of OG01 in breach of these Terms or applicable law.
This indemnity does not apply to the extent the loss or liability was caused by OG One Pty Ltd's own breach, negligence or unlawful conduct, and nothing in this indemnity requires you to indemnify OG One Pty Ltd for any liability that cannot lawfully be shifted or excluded, including under the Australian Consumer Law.
We may suspend or terminate access to OG01 where a user: materially breaches these Terms; misuses the service; creates a security risk; engages in unlawful use; or fails to pay an amount properly due. You may stop using OG01 or close an eligible account at any time, subject to outstanding payment obligations and the terms of any active agreement. Provisions concerning intellectual property, confidentiality, liability, payment obligations and governing law continue after termination where their nature requires them to survive.
These Terms are governed by the laws of New South Wales, Australia. Subject to any rights you have under applicable consumer law, disputes concerning these Terms or OG01 are subject to the jurisdiction of the courts of New South Wales.
We may update these Terms from time to time to reflect changes to OG01, our services or applicable law. The current version will be published on the OG01 website with the date of the latest update shown above. Material changes will apply prospectively unless otherwise required by law.
